� <br />� <br />EN HII,LS <br />MEMORANDUM <br />DATE: January 10, 2011 <br />TO: Honorable Mayor and City Councilmembers <br />Patrick Klaers, City Administrator <br />FROM: Kristine Giga, Civil Engineer <br />SUBJECT: Rice Creek Watershed District Maintenance Agreements for the 2007 <br />Pavement Management Program and the 2010 Pavement <br />Management Program <br />Background/Discussion <br />The Rice Creek Watershed District (RCWD) requires the installation and maintenance of <br />new storm water management facilities according to the district rules for city public <br />• works' projects, including street reconstruction projects. Storm water management <br />facilities, such as fitration basins and vegetated swales, are constructed within the right- <br />of- way as needed as part of the City's Pavement Management Program (PMP). <br />One of the permit requirements is to enter into a Maintenance Agreement covering the <br />maintenance of the new storm water management facilities. Maintenance of these <br />facilities is required by our Minnesota Pollution Control Agency Storm Water Pollution <br />Prevention Permit (SWPPP). It is also consistent with our Public Works policies to <br />adequately maintain infrastructure. <br />City staff and RCWD have been working to complete and close outstanding permits, and <br />have identified that final maintenance agreements need to be approved for two projects, <br />the 2007 PMP and the 2010 PMP. Copies of each of the agreements are attached. The <br />City Attorney reviewed the agreements and did not have any comments. <br />Stormwater features were constructed on three of the streets in the 2007 PMP. On <br />Brighton Way, curb cuts were installed to allow street runoff to filter through sod <br />outfalls, or swales, into an existing wetland. A weir structure was also constructed on the <br />outlet of the wetland to raise the outfalI elevation and provide additionai detention time, <br />which allows more pollutants to settle out of the runoff. A filtration basin was <br />constructed in the right-of-way along Royal Lane, adjacent to Floral Park.
