Ordinance 2010-012 <br />preliminary plat, final �lat, and conditionai use permit may atso be <br />� required. The applicant sha11 provide the fc�llowing: <br />1. A written statement describing the proposed development in the <br />PUD Final P1an application. <br />2. The �roposed starting and completion dates for the construction. <br />3. The applicant sha11 submit documentation demonstrating that the <br />PUD Final Plan is in conformance with the PUD Master Plan. <br />C. Development Agreement and Bonding. <br />l. A development agreement and corporate surety may be required at <br />the time of PUD Final Plan approval by the City Cauneil to assure that <br />al] improvements to be constructed as part of the approved PUD Final <br />Plan are completed in accardance with the terms at�d conditions of <br />such plan, ar each siage thereof as outiined in the constructzon siaging <br />component. The bond shall guarantee in a penal suin equal ta one <br />hc�ndred twenty-five { 125) percent of ihe cast af such improvements as <br />estimated by the City. The development agreemer�t and bond sha11 be <br />f led with the administratar no Iater than sixty {60} days after PUD <br />Final Plan approval. <br />2. The development agreement may provide for several bonds <br />covering separate aspects of tY�e PUD, ihe aggregate of which shall <br />total one hundred twenty-five (125} percent of all the improvements tt� <br />be consiructed and completed by the applicar�t pursuant to the <br />approved PUD Fina1 P1an. In ihis case, each bond rec}�ired by the <br />development agreement shali be filed no later than sixty {64} days <br />after PUD Fi�a1 Plan apprQval. It may alsa require guarantee bonds in <br />the penal sum of one hundred ( l OQ) percent of the cast of completed <br />improvemenis, as estimated by Ehe City Er�gineer to guarantee such <br />improve�ents far whatever lengths of time are specified therein. The <br />release of any bond or a�y portion thereaf shall either be governed by <br />the ierms and provisions af the development agree�ment or shali be <br />based upon the recammendation of the City E�gineer or City Planner <br />and approval by the City Cvuncil. <br />3. If the applicant fails to enter into a development agreement and to <br />file the corporate surety bond with the administratar by the expiration <br />of the sixty day period, the PLTD Permii, Final Plat (if any) and <br />approved PUD Finat Plan shal] be deemed void, nul]ified and revoked <br />unless an extension is requested in writing by the applicant and for <br />gaad cause granted by the City Cauncil. <br />� <br />Page 83 of 84 <br />
