AGENDA ITEM 9B <br /> <br />City of Arden Hills <br />City Council Meeting for February 29, 2016 <br /> <br />P:\Planning\Planning Cases\2015\PC 15-020 - Zoning Code Amendment - Retail and Resale Businesses\Memo_Reports_15-020 <br />Page 2 of 4 <br /> <br />Staff presented options for amending the Zoning Code to address thrift store businesses at the <br />City Council Work Sessions on October 19, 2015, and December 21, 2015. The City Council <br />directed staff to proceed with a Zoning Code Amendment that would create a new land use <br />category for Thrift Store and establish specific Conditional Use Permit criteria for thrift store <br />businesses. Additionally, the City Council agreed that the thrift store land use should only be <br />allowed in the B-4 Zoning District and be classified as a conditional use. On February 3, 2016, <br />the Planning Commission held the public hearing for the Zoning amendments related to the thrift <br />store use and voted (3-2, Holewa, Bartel) to recommend approval of the proposed amendment <br />but include the B-2, B-3, and I-Flex District along with the B-4 District as districts where thrift <br />stores should be classified as conditional. <br /> <br /> <br />Summary of Proposed Ordinance Amendments and Additions <br /> <br />Section 1305 – Definitions <br />The definitions section of the Zoning Code would be updated to clarify the differences between <br />“Retail Sales and Service” and “Thrift Store” establishments. A draft amendment to Section <br />1305.04 Definitions has been provided in Attachment E. <br /> <br />Section 1320 – Land Use Chart <br />The Land Use Chart in Section 1320.05 of the Zoning Code has been updated to reflect the <br />proposed amendment and now lists Thrift Stores as a conditional use in the B-2, B-3, B-4, and I- <br />Flex Zoning District. No changes have been made to the Land Use Chart related to the Retail <br />Sales and Service land use. The draft Land Use Chart can be reviewed in Attachment F. <br /> <br />Section 1325 – Conditional Use Criteria <br />New language has been proposed to update the Zoning Code in order to identify specific <br />Conditional Use Permit (CUP) criteria for Thrift Stores. Staff has drafted Section 1325.046 <br />Thrift Store Additional Conditional Use Permit Criteria for your review in Attachment G. <br /> <br /> <br />Discussion <br /> <br />At the Planning Commission meeting on February 3, 2016, the Commission discussed the Code <br />amendments for retail and thrift store establishments at length. The discussion largely focused <br />on the limited Zoning Districts in which thrift stores would be either permitted or conditional and <br />the need for additional standards for these establishments. The majority of the Commission <br />agreed that the proposed Code amendments were reasonable in order to clarify the different uses, <br />update the Land Use Chart, and to include the Conditional Use Permit Criteria for thrift stores. <br />The Commission recommended approval (3-2, Holewa and Bartel) of the proposed amendment <br />but decided to also include the B-2, B-3, and I-Flex Districts as districts where thrift stores <br />should be classified as conditional.
