186093v4 <br />(“Property”). Said Development Agreement shall remain in full force and effect except as <br />specifically amended herein. <br /> 2. The Development Agreement references plans and documents which represent the <br />nature, scope and configuration of the development, approved by the City, relating to, among <br />other items, landscaping and exterior elevations. Said Plans are as follows: <br />L1 Tree Preservation Plan dated 1/29/15 <br />L2 Tree Mitigation Plan dated 1/29/15 <br />L3 Landscaping Plan dated 1/29/15 <br />L4 Landscape Detail dated 1/29/15 <br />A3.1 Exterior Elevations Building 1 dated 12/12/14 <br /> 3. During the construction phase of Building 1 of the Red Fox Business Center, the <br />Developer omitted a section of windows and facade enhancements around the window opening <br />area. The City is willing to review Addendums to the above-referenced Plans to correct the <br />deficiencies as long as the Developer agrees to include additional screening on the revised <br />Landscaping and Building Plans attached hereto as Exhibit B, which Plans shall be pre-approved <br />by the City prior to the issuance of a final Certificate of Occupancy for Building 1. <br /> 4. Conditions. The PUD Amendment is issued subject to the following conditions: <br />1. That the project shall be completed in accordance with the submitted plans <br />as amended by the conditions of approval. Any significant changes to <br />these plans, as determined by the City Planner, shall require review and <br />approval by the Planning Commission and City Council. <br />2. That the applicant shall continue to abide by all previous agreements, as <br />amended by the conditions of approval of this application. <br />3. That a Planned Unit Development (PUD) Amendment Agreement shall be <br />prepared by the City Attorney and subject to City Council approval. The <br />PUD Amendment Agreement shall be signed by the applicant and <br />approved by Council prior to the issuance of a Final Certificate of <br />Occupancy for Building 1. <br />4. That the approved Landscaping Plan (L3) shall be amended to include <br />three (3) spruce trees in the northwest corner of Building 1. The change to <br />L3 shall be completed as depicted on the Landscape Screening Graphics <br />1A and 1D. <br />5. That the approved Landscaping Plan (L3) shall be amended to include <br />eight (8) lilac trees along the western property line. The change to L3 <br />shall be completed as depicted on the Landscape Screening Graphics 1C <br />and 1E. <br />6. That the approved Landscaping Plan (L3) shall be amended to include <br />climbing ivy in the northwest corner of Building 1. The change to L3
