This action replaced the previous zoning of the site as Mixed Residential <br />and Mixed Business. The purpose of the proposed amendment is to remove all references in the <br />Zoning Code related to Mixed Residential and Mixed Business Districts. The amendment would <br />not affect any properties in the City as there are currently no properties zoned Mixed Residential <br />or Mixed Business. <br /> <br />The City Attorney has drafted Ordinance Number 2016-006 and the Summary for publication <br />(Attachments A and B). The red-lined version of the proposed amendment has also been <br />provided in Attachment C. <br /> <br /> <br />Findings of Fact <br /> <br />The Planning Commission reviewed Planning Case 16-009 at their regular meeting on April 6, <br />2016. Draft minutes from the meeting are included in Attachment F. The Planning Commission <br />offers the following findings of fact for consideration: <br /> <br />1. The City Council approved the TCAAP Master Plan on July 13, 2015, which included the <br />adoption of the TCAAP Redevelopment Code (TRC) as Section 1380 of the Zoning Code <br />and the rezoning of the 427-acre TCAAP property based on the zoning designations in <br />the TRC Regulating Plan. <br />2. The adoption of the TRC and the rezoning of the TCAAP property based on the TRC <br />Regulating Plan replaced the previous zoning of the 427-acre site as Mixed Business <br />District and Mixed Residential District. <br />3. The proposed Zoning Code amendments would remove all references in the Zoning Code <br />to the Mixed Residential and Mixed Business Districts as these districts were created as a <br />“placeholder” for the TCAAP property until a Master Plan was approved by the City. <br />4. The proposed Zoning Code amendments would not have an effect on any properties in <br />the City as there are currently no properties zoned Mixed Residential or Mixed Business. <br />5. The proposed Zoning Code amendments are in conformance with the 2030 <br />Comprehensive Plan. <br />6. The proposed amendments will create greater consistency between the Zoning Code and <br />the 2030 Comprehensive Plan. <br /> <br /> <br />Recommendation <br /> <br />The Planning Commission reviewed Planning Case 16-009 at their regular meeting on April 6, <br />2016, and unanimously recommends approval (7-0) of the proposed amendment to Chapter 13, <br />Sections 1320.02, 1320.04, 1320.05, 1320.06, and 1320.135 of the Arden Hills City Code based <br />on the findings of fact as presented in the April 25, 2016, Report to the City Council.
