<br />4 <br />188032v2 <br /> <br />The Project Plans shall not be attached to this Agreement but, upon approval by the City Council, shall be <br />deemed fully incorporated by reference into this Agreement as if initially set forth entirely herein. Any <br />significant changes to the Project Plans, as reasonably determined by the City Planner, shall require review <br />and approval by the City of Arden Hills Planning Commission and the City Council. If the Project Plans, as <br />approved by the City Council, vary from the terms of this Agreement, the approved Project Plans shall <br />control. <br /> <br />C. PUD Master Plan. <br />1. The Developer shall apply for a Final Phase II PUD within one (1) year of the <br />approval of the Final Phase 1 PUD or the approval shall expire unless extended by the <br />City Council prior to the approval’s expiration date. Extension requests must be <br />submitted in writing to the City at least forty-five (45) days prior to the expiration date of <br />the Final Phase 1 PUD approval. <br />2. A “Master PUD Agreement” and a “Phase I Development Contract” shall be <br />prepared by the City Attorney for the City of Arden Hills and subject to the City Council <br />approval and the Developer. The Master PUD Agreement and Final Phase I <br />Development Contract shall be executed prior to the issuance of any Development <br />permits for Phase I. <br />D. Phase 1-Final Plan. <br />1. The Developer shall obtain a permit within one (1) year of the Final Phase 1 <br />PUD approval or the approval shall expire unless extended by the City Council prior to <br />the approval’s expiration date. Extension requests must be submitted in writing to the <br />City at least forty-five (45) days prior to the expiration date of the Final Phase 1 PUD <br />approval. <br />2. The Developer shall provide a construction phasing plan that includes plans for <br />fire and police access throughout construction, subject to the approval of the Fire
