Final plans for this <br />improvement shall be approved by Ramsey County and the City Engineer. <br />18. The Developer will ensure that the roof-mounted mechanical equipement is <br />screened from pubic view, and approves installation consistent with the approved plans <br />and has approved deviations or variances from ordinances, codes or other requirements <br />necessary to complete the installations consistent with the approved plans. <br />19. That the Final Plans for both Phase 1 and Phase 2 of the Devleopment shall be <br />revised to meet the standards as outlined by the City Engineer in the Memorandum dated <br />June 27, 2016 and July 6, 2016. <br />20. The Developer shall comply with all other City regulations regarding the <br />Development except to the extent the approvals related to the Devleopment included <br />variances from ordinances, codes or other requirements necessary to complete the <br />improvements by the Devleopment. <br /> 3. PHASED DEVELOPMENT. This Agreement is a phase of a multi-phased <br />development. The City may refuse to approve subsequent phases if the Developer has defaulted under <br />this Agreement , Master PUD Agreement, or Phase I Development Contract, and the default has not been <br />remedied within a reasonable period of time after the Developer receives the City’s written notice <br />regarding the default. <br /> 4. CHANGES IN OFFICIAL CONTROLS. For two (2) years from the date of this <br />Agreement, no amendments to the City's Comprehensive Plan, or official controls shall apply to or affect the <br />use, development density, lot size, lot layout or dedications of the approved Development unless required <br />by state or federal law or agreed to in writing by the City and Developer. Thereafter, notwithstanding <br />anything in this Agreement to the contrary, to the full extent permitted by state law, the City may require <br />compliance with any amendments to the City's Comprehensive Plan, official controls, platting or dedication
