<br />City of Arden Hills <br />City Council Meeting for August 8, 2016 <br />P:\Planning\Planning Cases\2016\PC 16-020 - Opt-Out Ordinance - Mobile Residential <br />Homes\Memos_Reports_16-020 <br /> <br />Page 1 of 3 <br />CONSENT ITEM – 5E <br /> MEMORANDUM <br /> <br />DATE: August 8, 2016 <br />TO: Honorable Mayor and City Councilmembers <br /> Sue Iverson, Acting City Administrator <br /> <br />FROM: Matthew Bachler, Senior Planner <br /> <br />SUBJECT: Planning Case #16-020 <br /> Applicant: City of Arden Hills <br /> Subject: Zoning Code Amendment – Temporary Family Health Care Accessory <br /> Dwellings <br /> <br /> <br />Requested Action <br /> <br />1) Motion to approve Ordinance Number 2016-007 in Planning Case 16-020 to opt-out of <br />the requirements of Minnesota Statutes, Section 462.3593 regarding temporary family <br />health care accessory dwellings, as presented in the August 8, 2016, Report to the City <br />Council. <br /> <br />2) Motion to approve publishing a Summary of Ordinance Number 2016-007 (4/5 vote <br />required). <br /> <br /> <br />Background <br /> <br />The State legislature passed a bill this session establishing a new permitting process for <br />temporary family health care accessory dwellings. The law applies to dwellings used for short- <br />term care purposes for family members in need of assistance. Under the new regulations, these <br />dwellings would require permitting from the City, but would be exempt from certain provisions <br />within the City’s land use and building regulations. A provision in the law allows cities to opt- <br />out of the law if an ordinance is approved before it goes into effect on September 1, 2016. <br /> <br />Staff presented the following areas of concern regarding the new law at the City Council Work <br />Session on July 18, 2016:
