<br /> <br />AGENDA ITEM – 6C <br /> <br /> <br /> <br /> <br />MEMORANDUM <br /> <br /> <br />DATE: September 12, 2016 <br /> <br />TO: Honorable Mayor and City Council <br /> Sue Iverson, Interim City Administrator/Director of Finance and Admin Services <br /> <br />FROM: Dave Perrault, Finance Analyst <br /> <br />SUBJECT: Adopt Policy for Donation of Surplus City Equipment <br /> <br /> <br />Background <br /> <br />The Council expressed interest in adopting a policy to donate surplus City equipment to nonprofit <br />organizations pursuant to state law. The League of Minnesota Cities recently published information <br />regarding background information, applicable state statutes, and a model policy for cities to consider <br />adopting. Attached is the background information, and policy for Council to review and provide feedback. <br />The city attorney reviewed the policy and did not raise any major objections. <br /> <br />Policy Highlights: <br /> <br />• Council will set the standard for how and when surplus equipment is identified and approved for <br />donation <br />• Council will set the standard for which organizations will be allowed to accept donated equipment <br />• Provides additional tort immunity to municipalities assuming there was no fraud or intentional <br />misrepresentation <br /> <br />Discussion <br /> <br />The City Council reviewed the policy at a previous work session and approved the policy to be moved to a <br />City Council meeting for approval. <br /> <br />Attachment <br /> <br />A.
