NEW BUSINESS—9A <br /> 'It <br /> ,-ARZEN HILLS <br /> MEMORANDUM <br /> DATE: June 27, 2016 <br /> TO: Honorable Mayor and City Councilmembers <br /> Susan Iverson, Acting City Administrator <br /> FROM: John Anderson, Acting Public Works Director <br /> SUBJECT: Night Work Construction Activity Waiver <br /> Lexington Avenue/ County Road F <br /> Requested Action <br /> Approve the Night Time Construction Activity Waiver for the Lexington Avenue/ County Road <br /> F project for overnight concrete sawing. <br /> Background/Discussion <br /> The concrete paving that is being placed on Lexington Avenue requires sawing of joints to take <br /> place within a short period of time as the concrete begins to cure. Typically, the joints need to be <br /> sawed within a 6 to 12 hour window and that occurs the night following the paving operations. <br /> City ordinance does not allow work to take place between the hours of 9:00 PM and 7:00 AM. <br /> City Ordinance does allow for a Waiver to the Ordinance to allow night time operations. The <br /> specific wording of the Ordinance is reproduced below: <br /> Section 630 - Construction Activities <br /> 630.01 Prohibited Activities. <br /> No person shall engage in or permit construction activities involving the use of any kind of <br /> electric, diesel or gas powered machine or other power equipment except between the hours of <br /> 7:00 a.m. and 9:00 p.m. on any weekday or between the hours of 8:00 a.m. and 9:00 p.m. on any <br /> weekend or holiday. <br /> 630.10 Prohibited Activities. <br /> Except as allowed by permit of the City Council, no person shall engage in or permit <br /> construction activities involving the use of any kind of electric, diesel or gas powered machine <br /> or other power equipment except between the hours of 7:00 a.m. and 9:00 p.m. on any weekday <br /> or between the hours of 8:00 a.m. and 9:00 p.m. on any weekend or holiday.
