The PUD process allows for flexibility within the City’s regulations through a negotiated <br />process with a developer. <br /> <br />Recommendation <br /> <br />Based on the submitted plans and findings of fact, staff recommends approval of Planning Case <br />16-031 for a PUD Amendment at 4001 Lexington Avenue North. If the City Council makes a <br />motion to approve this request, staff recommends that the following four conditions be included <br />with the approval: <br /> <br />1. The applicant shall continue to abide by all previous agreements, as amended by the <br />conditions of approval of this application. <br />2. A Planned Unit Development (PUD) Amendment Agreement shall be prepared by the <br />City Attorney and subject to City Council approval. <br />3. The elevator equipment enclosure shall not exceed a height of 18 feet and shall not <br />have a footprint greater than 21 feet by 29 feet or 609 square feet. <br />4. The elevator equipment enclosure shall be painted to match the color of the building. <br /> <br />Proposed Motion Language <br /> <br />1. Approve the proposal with conditions (Recommended Action). <br />2. Approve the proposal as submitted. <br />3. Deny the application with reasons for denial. <br />4. Table for additional information. <br /> <br />Public Notice <br /> <br />In this case, a public hearing was not required per Section 1355.06 Subd. 4 of the Arden Hills <br />City Code. <br /> <br />Deadline for Agency Actions <br /> <br />The City of Arden Hills received the completed application for this request on November 9, <br />2016. Pursuant to Minnesota State Statute, the City is required to act on this request by January <br />8, 2017, (60 days), unless the City provides the petitioner with written reasons for an additional <br />60-day review period. <br /> <br />Attachments <br /> <br />A.
