Page 2 of 3 <br /> <br />Civic Property <br /> <br />Concern about the control of the future use of the Civic property was raised at the November 21 <br />Work Session. Staff has discussed with the City Attorney the City’s options if a civic use could <br />not be identified and a rezoning was requested to another use. Since the uses allowed in the <br />Civic zone are not normally revenue generating, recent court decisions would support a rezoning <br />to another zone that has economic opportunities. If the City Council is concerned about the <br />future land uses of the Civic property, two of the available opportunities existing for some surety <br />of its ultimate use include: <br />1. The City’s acquisition of the property. <br />2. An agreement with the developer including at least: <br />a. A minimum timeframe in which a civic use will be pursued. <br />b. The opportunity for the City to acquire the property after that timeframe has <br />expired. <br />c. The general use of the property if the City chooses not to acquire the property. <br /> <br />There may be additional options available. Staff requests direction from the City Council on the <br />surety that is needed about the ultimate use of the Civic property. <br /> <br />Town Center Zoning <br /> <br />Based on the conversations during October 31 Work Session, staff has prepared revisions to the <br />Town Center district. The revisions are summarized as follows: <br /> <br />Proposed Revision Section Page <br />Requirement of 75% retail on the ground floor of buildings along the mall. Table 5-2 Pages 37 <br />Minimum residential units sizes for discussion (no sizes recommended) 6.3 (b) Pages 48 <br />Building height requirements for Town Center District 6.3 (c) Pages 49 <br />Concrete podium requirement for the ground floor of buildings along the <br />mall. 6.3 (c) Pages 49 <br /> <br />Other Open Issues <br /> <br />The amount of Retail Mixed-Use and Office Mixed-Use land was mentioned at the November 21 <br />Work Session. Staff requests clear direction on the amount of land that should be designated <br />Retail Mixed-Use and the amount of land that should be designated Office Mixed-Use. <br /> <br />The front porch decking requirements and the garage door requires have been added to Section <br />7-3 on page 77. <br /> <br />Summary <br /> <br />A copy of the TCAAP Regulating Plan has been provided in Attachment A and copy of the <br />Town Center zoning is provided in Attachment B. The TRC amendment and the TCAAP
