An easement is proposed along the inside of <br />each Parcel A (6 feet) and Parcel B (12 feet) to accommodate the existing sewer line. <br /> <br /> <br />Two variances are also being requested. The first is to allow a 5 foot deviation from Section <br />1320.06 District Requirements Chart of city code, which requires a lot width of 95 feet. The <br />second variance is to allow a deviation from the requirement in Section 1150.04 of city code, <br />which requires that requests for subdivision meet the required dimensions in order to be eligible <br />for division. <br /> <br />Plan Evaluation <br /> <br />A full evaluation of the proposal was presented to the Planning Commission at their November <br />9, 2016, Regular Meeting. The staff report to the Planning Commission on this case is included <br />in Attachment E. The proposed lots at meet the underlying requirements of the R-1 District for <br />lot area, structure coverage, and landscape coverage. Parcel A meets the R-1 District <br />requirements for lot width and the Planning Commission recommended approval of a lot width <br />variance of 5 feet for Parcel B. The proposal would not create any new or increase existing <br />nonconforming setbacks for structures on either property. <br /> <br />Subdivision Ordinance <br /> <br />Section 1150.04 of the City Code lists the requirements for subdividing and/or consolidating <br />previously platted property. Requirements that must be evaluated as listed under Section 1150.04 <br />include: <br /> <br />1. Survey: A survey showing the existing and proposed lots. <br />2. Zoning Compliance: The parcels or tracts resulting from the division or consolidation, as <br />depicted in the survey or registered land survey, shall not have an area, dimensions, or <br />setbacks which are less than the minimum requirements specified for the zoning district <br />in which the parcels or tracts are located in the zoning ordinance. <br />3. Public Welfare: It is determined that the proposed division or consolidation will not be <br />detrimental to the public welfare or injurious to adjacent tracts in the area in which the <br />subdivision tract is located. <br />4. Conformity with the rest of the Subdivision Ordinance: The proposed division or <br />consolidation shall conform to all requirements of the subdivision Ordinance unless given <br />an exemption by the Planning Commission and City Council. <br />5.
