<br />City of Arden Hills <br />City Council Meeting for December 12, 2016 <br />P:\Planning\Planning Cases\2016\Lake Johanna Water Surface Use Ordinance\Memos_Reports_CC Report (12- <br />12-16) <br /> <br />Page 1 of 3 <br />CONSENT ITEM – 7D <br /> MEMORANDUM <br /> <br />DATE: December 8, 2016 <br />TO: Honorable Mayor and City Councilmembers <br /> Sue Iverson, Interim City Administrator <br /> <br />FROM: Eric Zweber, Senior Planner <br /> <br />SUBJECT: Planning Case 16-032 <br /> Applicant: City of Arden Hills <br />Request: Ordinance No. 2016-013 <br /> <br /> <br />Requested Action <br /> <br />Motion to approve Ordinance No. 2016-013: An Ordinance Amending Chapter 7, Section 700.06 <br />to adopt slow-no wake speed restrictions on Lake Johanna during specified high water periods. <br />Ordinance will then be sent to DNR for approval. If approval is given, Ordinance will then be <br />adopted. <br /> <br />Background <br /> <br />Over the last several years, the City Council has had to convene an emergency meeting to <br />declare slow-no wake speed restrictions on Lake Johanna during times when the water was very <br />high. Due to the time it takes to convene an emergency session, the speed restrictions were not in <br />place quickly enough. It is the goal of the City to be able to implement these restrictions <br />administratively during times of need. This will allow the restrictions to be in place without <br />delay and without having to convene an emergency meeting. <br /> <br />In order to pass a Water Surface Use Ordinance, certain Minnesota Department of Natural <br />Resources (DNR) requirements must be completed. The DNR requires a Water Surface Use <br />worksheet be submitted, a map created of the area, public feedback be accepted and the proposed <br />Ordinance be submitted to the DNR. After they have received all of the application materials, <br />they make the determination on whether or not to accept the proposed Ordinance. <br /> <br />Staff prepared the Water Surface Use worksheet, and it is Attachment B of this report.
