<br />City of Arden Hills <br />City Council Meeting for March 13, 2017 <br />P:\Planning\Planning Cases\2017\PC 17-005 - Boston Scientific - Wetland Easement Vacation\Memos_Reports_17-005 <br /> <br />Page 2 of 3 <br /> <br />applied towards the unapproved wetland removal and it does not appear that additional <br />mitigation will be required at this time. <br /> <br /> <br />Discussion <br /> <br />The City will typically require property owners to grant drainage easements at the time of <br />subdivision or new development in order to protect private drainage facilities that connect <br />into and impact public stormwater infrastructure. The purpose of having these easements in <br />place is to ensure that the City can perform maintenance on private stormwater facilities in <br />the event the work is not completed by the property owner. <br /> <br />The legal document for the easement states that at the time it was granted, it was the policy <br />of RCWD to request that property owners convey to the appropriate municipality drainage <br />easements over protected wetlands. The purpose of this policy was, in part, to notify future <br />property owners of land use limitations. <br /> <br />The Public Works Director has reviewed the proposed easement vacation and provided a <br />memo addressing why that part of the easement that would be vacated is not needed for <br />public purposes (Attachment D). Both wetland areas were naturally occurring and were not <br />modified to serve as stormwater drainage facilities for the Boston Scientific campus. <br /> <br />Notice of Public Hearing <br /> <br />Drainage easement vacations require a public hearing before the City Council. Notice of the <br />public hearing was published in the Arden Hills/Shoreview Bulletin and notice was prepared <br />by the City and mailed to property owners within 350 feet of the subject property. <br /> <br /> <br />Public Comments <br /> <br />Staff has not received any letters, e-mails, or telephone calls from property owners or <br />residents in regards to this request. <br /> <br /> <br />Recommendation <br /> <br />Staff recommends approval of Resolution No. 2017-006 to vacate a part of the drainage <br />easement granted to the City of Arden Hills and recorded as Document No. 2671697 on the <br />Boston Scientific campus, located at 4100 Hamline Avenue North. <br /> <br /> <br /> <br />
