Joynes, Sr., City Administrator <br /> <br />FROM: Sue Polka, Public Works Director/City Engineer <br /> <br />SUBJECT: Rice Creek Watershed District Maintenance Agreement for the 2015 <br />Pavement Management Program <br /> <br /> <br />Background/Discussion <br /> <br />The Rice Creek Watershed District (RCWD) requires the installation and maintenance of <br />new storm water management facilities according to the district rules for city public <br />works’ projects, including street and utility improvement projects. Storm water <br />management facilities, such as infiltration basins and rain gardens, are constructed within <br />the right- of- way or in trail easements as needed as part of the City’s PMP projects. <br />Seven facilities will be constructed as a part of the 2015 PMP. <br /> <br />One of the permit requirements is to enter into a Maintenance Agreement covering the <br />maintenance of the new storm water management facilities. Maintenance of these <br />facilities is required by our Minnesota Pollution Control Agency Storm Water Pollution <br />Prevention Permit (SWPPP). It is also consistent with our Public Works policies to <br />adequately maintain infrastructure. A copy of the agreement is attached. <br /> <br />Seven rain gardens were constructed as a part of the 2015 PMP on City rights of way or <br />within existing easements. One garden is located on Grant Road, four on Noble Road, <br />and two along trails within the project area as shown on Exhibits A and A2 of the <br />agreement. <br /> <br />Financial Implications <br /> <br />The Public Works Department is committed to maintaining new facilities when they are <br />installed. This agreement does not increase our level of maintenance over what we <br />would have done without the agreement. Five of the gardens are located in residential <br />yards and will be maintained by the property owners. Additional raingardens were <br />constructed with the project but are not covered by this agreement and also will be <br />maintained by the property owners.
