188636v2 each and every day of the week, no motorboat shall be operated at a speed in excess of five (5) miles per hour. At all other times during each and every day of the week, no boats shall be operated in the open zone at a speed in excess of 40 miles per hour. Subd. 5 Direction of Travel in Open Zone During Certain Times. Within the open zone, during the hours in which operating speeds of up to forty (40) miles per hour are permitted, all motorboats shall travel and be operated in a counterclockwise direction around Lake Johanna. Subd. 6. Notice and Enforcement. Notification and enforcement of the speed restrictions established shall include placement of any necessary signs at public watercraft accesses and buoys as provided in Section 700.04 and state law, however, nothing herein shall preclude additional efforts of public notification nor preclude enforcement by other licensed peace officers. Subd. 7. Violation Penalty. Any person, firm or corporation who violates any section of this chapter shall be guilty of a misdemeanor and, upon conviction, thereof, shall be subject to a misdemeanor penalty as then defined by Minnesota law. Additionally, the City may exercise any civil remedy available under Minnesota law for the enforcement of this code including civil action, mandamus, injunctive relief, declaratory action, or the levying of assessments. SECTION 2. This Ordinance shall become effective immediately upon its passage and publication according to law.
