ARDEN HILLS CITY COUNCIL—APRIL 24, 2017 5 <br /> 7. Flexibility through the PUD process has been requested in the following areas: landscape <br /> coverage, drive-up window requirements, planting island coverage, location and number <br /> of off-street parking stalls, building materials, site furnishings and seating, and <br /> freestanding signage. <br /> 8. The proposed development plans exceed the minimum requirements of the City Code in <br /> the following areas: minimum caliper inches, street trees, and commercial fagade <br /> transparency. <br /> 9. The Master PUD Amendment and Final PUD for Phase 2 are in conformance with the <br /> Arden Hills 2030 Comprehensive Plan. The properties at 3771 and 3833 Lexington <br /> Avenue North and 1120 Red Fox Road are guided for Commercial. The Commercial land <br /> use category is applied to areas designated for a broad range of retail shopping and <br /> services to meet the needs of the community. Compatible uses such as office buildings are <br /> also intended for this area. <br /> 10. The application is not anticipated to create a negative impact on the immediate area or the <br /> community as a whole. <br /> Senior Planner Bachler stated the Planning Commission unanimously recommended approval <br /> (5-0) of Planning Case 17-008 and included 19 conditions of approval. The following three <br /> conditions were subsequently addressed by the applicant and are reflected in the revised <br /> development plan set. These conditions have been removed from the recommended motion <br /> language below: <br /> • The western access driveway on Red Fox Road shall be redesigned to have the same <br /> radius as the eastern access driveway on Red Fox Road. <br /> • Sheet C2 shall be revised to include "Do Not Enter" and"One-Way" signs for the Phase 2 <br /> drive-thru. <br /> • Prior to City Council review, the parking stalls at the southwest corner of the Phase 2 site, <br /> immediately south of the trash enclosure, shall be removed from the development plans so <br /> as to allow for adequate fire truck circulation. <br /> Senior Planner Bachler reported the Planning Commission recommends approval of Planning <br /> Case 17-008 for a Master PUD Amendment and Final PUD at 3771 and 3833 Lexington Avenue <br /> North and 1120 Red Fox Road, based on the findings of fact and the submitted plans in the April <br /> 24, 2017, Report to the City Council, as amended by the following sixteen (16) conditions: <br /> 1. The Developer shall continue to abide by the conditions of all previous Master PUD <br /> Agreements, permits, and reviews, except as hereinafter amended. <br /> 2. The project shall be completed in accordance with the submitted plans as amended by the <br /> conditions of approval. Any significant changes to these plans, as determined by the City <br /> Planner, shall require review and approval by the Planning Commission and the City <br /> Council. <br /> 3. The Developer shall obtain the required development permits within one year of the <br /> approval date or the approval shall expire,unless extended by the City Council prior to the <br /> approval's expiration date. Extension requests must be submitted in writing to the City at <br /> least 45 days prior to the expiration date. <br />
