CONSENT ITEM—5D <br /> ,- i DEN HILLS <br /> MEMORANDUM <br /> DATE: May 22, 2017 <br /> TO: Honorable Mayor and City Councilmembers <br /> William S. Joynes, Sr., City Administrator <br /> FROM: Julie Hanson, City Clerk <br /> SUBJECT: Motion to Approve Ordinance 2017-003 Amending Chapter 5, Section 500, <br /> Subsection 500.16, of the Arden Hills City Code Permitting Off-Sale of <br /> Intoxicating Liquor on Sundays, and Conforming City Days and Hours of <br /> Operation for Off-Sale Intoxicating Liquor with State Law and Authorize <br /> Publication of the Ordinance Summary <br /> Background <br /> Off-sale of intoxicating liquor on Sundays was signed into state law on March 7, 2017. Under <br /> new law, Minnesota Chapter 340A specifically states off-sale of intoxicating liquor may occur <br /> on Sundays between the hours of 11 am and 6 pm. This law will be effective July 1, 2017. <br /> Cities that specifically prohibit off-sale of intoxicating liquors on Sunday are required to amend <br /> its ordinance to reflect this change. <br /> Chapter 5, Section 500, Subsection 500.16 of the Arden Hills City Code currently prohibits the <br /> sale of intoxicating liquor on Sundays by an off-sale licensee (see Subdivision 7, A. of <br /> Attachment B,redlined version). <br /> In order to comply with this new law, it is proposed to change Arden Hills' City Code language <br /> to reflect state law regarding Sunday off-sale of intoxicating liquor. By referring to hours of <br /> operation and days of sale as those set forth by Minnesota Chapter 340A, which could be <br /> amended from time to time, this will eliminate the need to change City Code each time the State <br /> makes an amendment to this particular law. That said, the City does reserve the right to be more <br /> restrictive than State law allows, should it so desire. <br /> The City currently has three establishments that hold off-sale licenses: Cub Foods, Cub <br /> Discount Liquor, and Welch's Big Ten Supper Club. By amending Chapter 5, Section 500, <br /> Subsection 500.16 of the Arden Hills City Code, these establishments will be eligible to sell <br /> intoxicating liquor on Sundays, should they so choose. <br />
