Additionally, the City Council agreed that the thrift store land use should only be <br />allowed in the B-4 Zoning District and be classified as a conditional use. The Planning <br />Commission discussed creating a separate land use category for thrift store business at their work <br />session on September 9, 2015. At that time, the Planning Commission did not support this type <br />of an amendment to the Zoning Code. <br /> <br /> <br />Summary of Proposed Ordinance Amendments and Additions <br /> <br />Section 1305 – Definitions <br />The following changes would be made to the definitions section of the Zoning Code to clarify <br />the differences between “Retail Sales and Service” and “Thrift Store” establishments. A draft <br />amendment to Section 1305.04 Definitions has been provided in Attachment A. <br /> <br />Retail Sales and Services: An establishment engaged principally in the sale or rental of <br />primarily new goods and the provision of services directly to the <br />consumer, excluding those uses defined more specifically in this <br />Code. Motor vehicle sales, motor vehicle leasing and rentals, <br />exterior equipment rental and sales lots, repair garages, pawn <br />shops, thrift stores, and open sales lots are not included in this <br />definition of retail sales and service. <br /> <br />Thrift Store: An establishment for which the stock of goods is primarily used <br />and includes the following operational characteristics: <br /> <br />1) Receipt of used items directly from the public at the business <br />location. <br />2) Processing, conditioning, cleaning, or repair of used or <br />returned items for resale. <br />3) Storage of used items on site for processing, resale, or disposal. <br />4) Receipt of goods through purchase, consignment, or donation. <br /> <br />Section 1320 – Land Use Chart <br />The Land Use Chart in Section 1320 of the Zoning Code has been update to reflect the proposed <br />amendment and now lists Thrift Stores as a conditional use in the B-4 Zoning District. No <br />changes have been made to the Land Use Chart related to the Retail Sales and Service land use. <br />The draft Land Use Chart can be reviewed in Attachment B. <br /> <br />Section 1325 – Conditional Use Criteria <br />In order to identify specific Conditional Use Permit (CUP) criteria for Thrift Stores the following <br />language would be added to the City’s Zoning Code. Staff has drafted Section 1325.046 Thrift <br />Store Additional Conditional Use Permit Criteria for your review in Attachment C. <br />
