Structure Setback – Variance Required <br /> <br />The existing dwelling is in conformance with <br />the R-1 District setback requirements. A <br />variance is needed in this case to allow for the <br />proposed three-season porch to encroach 3 feet <br />– 6inches into the required 30-foot rear yard <br />setback, creating a setback of 26 feet – 6 inches. <br />The porch would extend 12 feet from the rear <br />side of the house and measure 18 feet in width <br />for a total area of 216 square feet. The porch <br />includes a gas fireplace on the east side of the <br />structure and the cantilevered area for the <br />fireplace would extend 6 inches closer to the <br />rear property line. <br /> <br />The proposed project would include a deck that <br />would wrap around the southern side of the <br />house and be accessed through the new porch <br />addition. The deck would measure approximately 10 feet by 20 feet with a total area of 211 <br />square feet. While the deck would be constructed in line with the eastern side of the porch, a rear <br />yard setback variance would not be required for the deck portion of the project. Section 1325.03, <br />Subd. 2 (A) of the Zoning Code allows for certain parts of principal structures, including decks, <br />to extend into required setback areas. In the R-1 District, decks may extend six feet into the rear <br />yard setback but cannot be less than six feet from the lot line. The applicants would be allowed <br />to construct a deck up to 24 feet from the rear property line. As proposed, the deck would be <br />setback 27 feet from this lot line. <br /> <br />C. Structure Height – Conforming <br /> <br />The existing dwelling is 35 feet in height, which is the maximum height permitted in the R-1 <br />District. The proposed porch addition would be elevated above grade and constructed at the main <br />level of the dwelling. The height of the porch addition would be less than the height of the <br />existing house. <br /> <br />D. Lot Coverage – Conforming <br /> <br />The property is currently in conformance with the structure and landscape coverage requirements <br />for the R-1 District. The proposed addition would increase structure coverage by a total of 427 <br />square feet to 7.69 percent of the lot area. Landscape coverage would be reduced to 87.58 <br />percent. Properties in the R-1 District are permitted up to 25 percent structure coverage and must <br />maintain a minimum landscape lot area of 65 percent. <br /> <br /> <br />Applicable R-1 Lot Requirements <br />1.
