<br />City of Arden Hills <br />Planning Commission Meeting for July 6, 2016 <br /> <br />P:\Planning\Planning Cases\2016\PC 16-016 - Land O'Lakes - Final PUD Phase 2\Memos_Reports_16-016 <br />Page 12 of 15 <br />The IO area is designated for a broad range of light industrial uses such as warehousing <br />with manufacturing and office. <br /> <br /> <br />Recommendation <br /> <br />Based on the submitted plans and findings of fact, staff recommends approval of Planning Case <br />16-016 for a Final Planned Unit Development (PUD) for Phase 2 at 4001 Lexington Avenue <br />North. If the Planning Commission recommends approval of this request, staff recommends that <br />the following twenty-two (22) conditions be included with the approval: <br /> <br /> <br />1. That the project shall be completed in accordance with the submitted plans as <br />amended by the conditions of approval. Any significant changes to these plans, as <br />determined by the City Planner, shall require review and approval by the Planning <br />Commission and City Council. <br />2. That the applicant shall obtain a building permit within one year of the Final Phase 2 <br />PUD approval or the approval shall expire unless extended by the City Council prior <br />to the approval’s expiration date. Extension requests must be submitted in writing to <br />the City at least 45 days prior to the expiration date. <br />3. That the Final PUD - Phase 2 Development Contract shall be prepared by the City <br />Attorney and subject to City Council approval. The Final PUD - Phase 2 <br />Development Contract shall be executed prior to the issuance of any development <br />permits. <br />4. The applicant shall provide a construction phasing plan that includes plans for fire <br />and police access throughout construction, subject to the approval of the Fire <br />Marshall, Public Works Director, and Ramsey County Sheriff prior to the issuance of <br />any development permits. <br />5. The Developer shall submit a financial surety in the amount of $200,000 for site <br />improvements, including grading, utilities, and paving, prior to the issuance of any <br />development permits. Upon completion of required Developer improvements, and <br />acceptance by the City, the City may reduce the amount of security for the <br />improvements still to be completed. The financial surety shall be in the form of a <br />letter of credit issued by a FDIC -insured Minnesota bank, and be in a form acceptable <br />to the City. The purpose of the letter of credit is to ensure that private site <br />improvements stabilized in the event that the Developer defaults on the Final PUD - <br />Phase 2 Development Contract. <br />6. The Developer shall submit a cash escrow for site improvements, including grading, <br />utilities, and paving, in the amount of $20,000 prior to the issuance of any <br />development permits. The escrow will be used for City costs related to review, <br />approval, and inspection of site improvements or any costs incurred by the City in the <br />event of a developer default. If at any time during the course of construction on the <br />project the amount in the account is reduced to below $5,000, the Developer shall <br />replenish the account to not less than $20,000. In the event there is a failure to
