New Business <br />Legal Update — Mike Norton, Attorney for the JDA <br />e Review of Governance Model <br />• Update City/County Meeting Regarding Master Plan <br />Mike Norton provided the JDA with an update. He discussed the governance model through a <br />flow chart along with the approval process that would be followed for all future TCAAP <br />developments by the JDA. <br />Discussion ensued regarding the preliminary and final approval process for the TCAAP <br />Redevelopment Code (TRC), along with the level of flexibility within the TRC. <br />Commissioner Huffman believed there was a misunderstanding at the last JDA meeting <br />regarding the issue of flexibility. He questioned if the attorneys were able to discuss this <br />matter. <br />Mr. Norton commented that he spoke with City Attorney Jamnik and Assistant County Attorney <br />Paul Zisla regarding the TRC. All were in agreement that flexibility was granted to the JDA <br />within the TRC. Additional flexibility could be gained by removing or modifying some of the <br />items within the TRC that addressed density. For the time being, the JDA only had authority <br />insofar as was included within the TRC. <br />Commissioner Huffman feared that the preliminarily approved TRC would hinder future <br />opportunities for higher intensity developments. <br />Mr. Norton discussed his interpretation of this item with respect to the TRC. He advised that <br />developments would only be reviewed by the City Council if the density requested was higher <br />than allowed within the TRC. All other requests would be reviewed and approved by the JDA. <br />Commissioner Huffman asked if a five-year incremental Comprehensive Plan had been included <br />within the Comprehensive Plan Amendment (CPA). He believed that the TCAAP buildout should <br />include an infrastructure plan that would address the next 5, 10, 15 and 20 years. <br />Mr. Norton did not believe this to be the case. <br />Development Director Hutmacher clarified that this documentation update would be included <br />within the Alternative Urban Areawide Review (AUAR) as it had to be updated every five years. <br />Chair Sand stated it was his hope to relieve some of the dynamic tension in how the JDA moved <br />forward into the future. He wanted to see the JDA, the City and County move forward with <br />cooperation and collaboration as was called out with the JDA documentation. <br />
