Joynes, Sr., City Administrator <br /> <br />FROM: Matthew Bachler, Senior Planner <br /> <br />SUBJECT: Planning Case #16-017 <br /> Applicant: Christopher and Deniz Kindler <br /> Property Location: 1536 Edgewater Avenue <br /> Request: Variance Approval Extension <br /> <br /> <br />Requested Action <br /> <br />Motion to approve a one year extension for the Variance approved in Planning Case 16-017 for <br />the property at 1536 Edgewater Avenue and to establish a new approval expiration date of <br />September 12, 2018. <br /> <br /> <br />Background <br /> <br />On September 12, 2016, the City Council approved a Variance request for the property at 1536 <br />Edgewater Avenue (Planning Case 16-017). The approved Variance will allow the property <br />owners to construct a second garage stall on the east side of the existing dwelling with finished <br />living space above. A Variance was needed in this case to allow the addition to encroach 1 foot – <br />7 inches into the minimum 10-foot side yard setback, and for the property to have a combined <br />side yard setback of 20 feet – 7 inches where a minimum combined side yard setback of 25 feet <br />is required. <br /> <br />Section 1355.06, Subd. 3 of the Arden Hills Zoning Code states that approval of a Variance shall <br />automatically expire and become void one year from and after the date on which the City <br />Council granted such approval if the building permit has not been issued by the City Building <br />Official. The City Council may extend the expiration date of such approval upon written <br />application by the person to whom the approval was granted. The expiration date for the <br />Variance approved in Planning Case 16-017 is September 12, 2017. A building permit has not <br />yet been issued for this project.
