Joynes, Sr., City Administrator FROM: Matthew Bachler, Senior Planner SUBJECT: Planning Case #16-017 Applicant: Christopher and Deniz Kindler Property Location: 1536 Edgewater Avenue Request: Variance Approval Extension Requested Action Motion to approve a one year extension for the Variance approved in Planning Case 16-017 for the property at 1536 Edgewater Avenue and to establish a new approval expiration date of September 12, 2018. Background On September 12, 2016, the City Council approved a Variance request for the property at 1536 Edgewater Avenue (Planning Case 16-017). The approved Variance will allow the property owners to construct a second garage stall on the east side of the existing dwelling with finished living space above. A Variance was needed in this case to allow the addition to encroach 1 foot – 7 inches into the minimum 10-foot side yard setback, and for the property to have a combined side yard setback of 20 feet – 7 inches where a minimum combined side yard setback of 25 feet is required. Section 1355.06, Subd. 3 of the Arden Hills Zoning Code states that approval of a Variance shall automatically expire and become void one year from and after the date on which the City Council granted such approval if the building permit has not been issued by the City Building Official. The City Council may extend the expiration date of such approval upon written application by the person to whom the approval was granted. The expiration date for the Variance approved in Planning Case 16-017 is September 12, 2017. A building permit has not yet been issued for this project.
