2 <br />195265v3 <br />West 200 feet of the North 283 feet of the following described <br />tract: The North 872 feet of the East half of the Northeast <br />quarter of Section 34, Township 30, Range 23 West, except the <br />West 625 feet thereof; Also except, or subject to rights of the <br />public in, those portions thereof taken for Highway; said portions <br />being the North 43 feet thereof <br /> <br />(the “Property”). <br /> C. The Developer has requested approval to modify the existing parking lot and <br />drive-thru lane on the Property for a new fast food restaurant tenant, including additional wall <br />signage and improvements for a patio seating area outside. The new tenant would occupy the <br />vacant 4,500 square foot space in the building which is zoned B-2 General Business District. <br /> D. On the 2nd day of October, 2017, Developer submitted an application requesting <br />that the City approve an Amendment to the Agreement (“Application”) for modification and <br />improvement to the Property. <br /> E. The Developer’s Application included rearranging the Property’s drive-thru lanes <br />and parking lots, installing new signs, and constructing an outside patio seating area on the <br />Property (the “Development”). <br /> F. The Application is illustrated and described on the following documents, attached <br />and incorporated as part of Planning Case 17-024 on file and recorded at the City of Arden Hills: <br />1. Site Plan, Amended PUD with Existing Overlay dated 10/20/2017 <br />2. Site Plan, Amended PUD dated 10/20/2017 <br />3. Landscape Plan dated 10/02/2017 <br />4. Signage Plan dated 10/23/2017 <br /> <br />NOW, THEREFORE, THE PARTIES AGREE AS FOLLOWS: <br />1. PLANNING COMMISSION REVIEW. On the 8th day of November, 2017, the <br />City Planning Commission reviewed the Application and after considering the Application, the <br />submitted plans, the reports and comments of the City’s staff, the reports and comments of the <br />Developer, and other public comments, and subject to conditions, recommended approval of the <br />Application. <br /> 2. CITY COUNCIL REVIEW. On the 27th day of November, 2017, the City <br />approved an Amendment to the Agreement for the Development.
