considered timely made to Comcast if received within thirty (30) days after the invoice date, <br />however, customer's account shall provide for a fifteen (15) day Grace Period ("Grace Period") <br />immediately subsequent to the thirty (30) day payment remittance period. Any charges not paid to <br />Comcast within such period will be considered past due. If a Service Commencement Date is not <br />the first day of a billing period, Customer's first monthly invoice shall include any pro -rated <br />charges for the Services, from the date of installation to the start of the next billing period. <br />7. Article 3.7 "Other Government -Related Costs and Fees" is hereby modified to <br />read as follows: <br />Customer will pay fees or payment obligations in connection with the Services imposed by <br />governmental or quasi -governmental bodies in connection with the sale, use, or provision of the <br />Services, including, without limitation, applicable franchise fees, and universal service fund <br />charges (if any), regardless of whether Comcast or its Affiliates pay the fees directly or are required <br />by an order, rule, or regulation of a taxing jurisdiction to collect them from Customer. Taxes and <br />other government fees and surcharges may be changed with or without notice. In the event that a <br />newly adopted law, rule -or regulation imposes a new government fee or surcharge that increases <br />Comcast's costs of providing Services to Customer, Customer shall pay Comcast's additional costs <br />of providing Services to Customer under the new law, rule or regulation. <br />Notwithstanding the foregoing, this section does not apply to one-time permitting or other non- <br />recurring charges incurred by Comcast which are directly related to the construction of the <br />Network. <br />8. Article 3.8 "Disputed Invoice" is hereby modified to read as follows: <br />If Customer disputes any portion of an invoice by the due date, Customer must pay the undisputed <br />portion of the invoice and submit a written claim, including all documentation substantiating <br />Customer's claim, to Comcast for the disputed amount of the invoice by the invoice due date. The <br />Parties shall negotiate in good faith to resolve any billing dispute. Comcast will refund/credit all <br />valid disputes resolved in Customer's favor as of the date the disputed charges first appeared on the <br />Customer's invoice. Under no circumstances may Customer submit a billing dispute to Comcast <br />later than one -hundred eighty (180) days following Customer's receipt of the applicable invoice. <br />Except as otherwise provided herein, payment of any disputed amounts by Customer shall not <br />constitute a waiver of any rights or claims of Customer. In the event any part of this provision <br />conflicts with Minnesota Statute Section 471.425, the statute will govern. <br />9. Article 3.9 "Past -Due Amounts" is deleted in its entirety and replaced with the <br />following: <br />Customer will comply with Minnesota Statute Section 471.425. <br />10.
