7/21/2017 Chapter 13 - Zoning Code <br />http://library.amlegal.com/alpscripts/get-content.aspx 1/17 <br />Print <br />Arden Hills, MN Code of Ordinances <br />Section 1335 - Flood Plains <br />1335.01 Statutory Authorization. <br /> The legislature of the State of Minnesota has, in Minnesota Statutes Chapter 103F and Chapter 462 <br />delegated the responsibility to local government units to adopt regulations designed to minimize flood <br />losses. Therefore, the City Council of the City of Arden Hills, Minnesota does ordain as follows: <br />1335.02 Findings of Fact. <br /> Subd. 1 Hazards Exist. The flood hazard areas of the City are subject to periodic inundation which <br />results in potential loss of life, loss of property, health and safety hazards, disruption of commerce and <br />governmental services, extraordinary public expenditures or flood protection and relief, and impairment of <br />the tax base, all of which adversely affect the public health, safety, and general welfare. <br /> Subd. 2 Method Used to Analyze Flood Hazards. There regulations of this Section are based upon a <br />reasonable method of analyzing flood hazards which is consistent with the standards established by the <br />Minnesota Department of Natural Resources. <br /> Subd. 3 National Flood Insurance Program Compliance. This Ordinance is adopted to comply with the <br />rules and regulations of the National Flood Insurance Program codified as 44 Code of Federal Regulations <br />Parts 59 -78, as amended, so as to maintain the community's eligibility in the National Flood Insurance <br />Program. <br />1335.03 Statement of Purpose. <br /> It shall be the purpose of this Section to promote the public health, safety, and general welfare and <br />minimize those losses described in Section 1335.02 Subd 1. <br />1335.04 Zoning Code. <br /> The City of Arden Hill's Zoning Code is adopted by reference and made a part of this Section as if set out <br />in full. <br />1335.05 Regulatory Flood Protection Elevation. <br /> The Regulatory Flood Protection Elevation shall be an elevation no lower than one foot above the <br />elevation of the regional flood plus any increases in flood elevation caused by encroachments on the flood <br />plain that result from designation of a floodway. <br />1335.06 Lands to Which Regulations Apply. <br />Dr <br />a <br />f <br />t <br /> <br />11 <br />/ <br />2 <br />0 <br />/ <br />2 <br />0 <br />1 <br />7
