Developer shall remove or modify the deck on the existing single-family <br />dwelling at 3685 New Brighton Road in order to meet the side yard setback requirement and not <br />encroach on any drainage and utility easement prior to the issuance of a building permit for Lot 1 <br />or Lot 2, or the Developer shall be required to submit a cash escrow in the amount of $500.00 to <br />the City to ensure the removal of the deck within six (6) months from the approval of the Final <br />Plat. <br /> G. The Developer shall be required to stake metal markers along the drainage <br />easement abutting the stormwater basins and wetland with signs stating the area is a natural <br />vegetation/infiltration area and no dumping is allowed. The design of the signs shall be approved <br />by the City prior to installation. <br /> H. The Developer shall conform to all other City regulations. <br /> 18. RESPONSIBILITY FOR COSTS. <br /> A. Except as otherwise specified herein, the Developer shall pay all costs incurred by <br />it or the City in conjunction with the development of the plat, including but not limited to Soil and Water <br />Conservation District charges, legal, planning, engineering and inspection expenses incurred in connection <br />with approval and acceptance of the plat, the preparation of this Agreement, review of construction plans <br />and documents, and all costs and expenses incurred by the City in monitoring and inspecting development <br />of the plat. <br /> B. The Developer shall reimburse the City for reasonable costs incurred in the <br />enforcement of this Agreement, including engineering and attorneys' fees. <br /> C. The Developer shall pay, or cause to be paid when due, and in any event before <br />any penalty is attached, all special assessments referred to in this Agreement. This is an obligation of the <br />Developer and shall continue in full force and effect even if the Developer sells one or more lots, the entire <br />plat or property, or any part of it.
