CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 18-019 <br />RESOLUTION APPROVING THE VACATION OF THE <br />SEWER EASEMENT FOR ARDEN HILLS LIFT STATION #12 <br />AT 3685 NEW BRIGHTON ROAD. <br />WHEREAS, on December 4, 2017, Richard Kotoski, the representative for Timothy <br />Horita of 3685 New Brighton Road, submitted a completed application with the City of Arden <br />Hills to vacate the sewer easement at 3685 New Brighton Road on Lot 18 in the ROHLEDER’S <br />HOME & GARDEN ACRES Plat located within the City of Arden Hills, as proposed in <br />Planning Case 17-029; and <br />WHEREAS, the subject sewer easement was created by Document No. 579400 and is <br />depicted in Exhibit “A”; and <br />WHEREAS, Planning Case 17-029 included a concurrent request for a Preliminary Plat <br />and Final Plat that would dedicate a new drainage and utility easement to the City for the <br />operation of Lift Station #12 as depicted on the Final Plat in Exhibit “B”; and <br />WHEREAS, on the 12th day of March, 2018, a Public Hearing preceded by published, <br />posted, and mailed notice as required by Minn. Stat. §412.851 was conducted before the Arden <br />Hills City Council; and <br />WHEREAS, vacating the existing sewer easement and accepting the new drainage and <br />utility easement will not impact the function or use of Lift Station #12; and <br />WHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council <br />determined that vacating the existing sewer easement and accepting the new drainage and utility <br />easement was in the public’s interest. <br />NOW, THEREFORE,BE IT RESOLVED by the City Council of the City of Arden <br />Hills: <br />1. The existing sewer easement legally described and depicted on the attached Exhibit “A” is <br />hereby vacated, conditioned on the City Council approval of the Final Plat as proposed in <br />Planning Case 17-029 and as depicted on the attached Exhibit “B”. <br />2. The City Clerk is directed to file a certified copy of this Resolution with the County Auditor <br />and County Recorder/Registrar of Titles.
