<br /> <br /> <br /> <br /> <br /> <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 2018-026 <br /> <br />A RESOLUTION ENTERING INTO A LIMITED USE PERMIT WITH THE STATE OF <br />MINNESOTA, DEPARTMENT OF TRANSPORTATION, FOR A PEDESTRIAN TRAIL IN <br />THE RIGHT OF WAY OF INTERSTATE 35W AT COUNTY STATE AID HIGHWAY 73 <br />(COUNTY ROAD E2) <br /> <br /> WHEREAS, the City of Arden Hills is a political subdivision, organized and existing under the <br />laws of the State of Minnesota, and, <br /> <br /> WHEREAS, the City Council of the City of Arden Hills has approved a plan to construct a <br />pedestrian trail in the right-of-way of Interstate 35W at County Road E2; and <br /> <br /> WHEREAS, the State of Minnesota, Department of Transportation, requires a Limited Use <br />Permit for the construction and utilization of said pedestrian trail. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ARDEN <br />HILLS, MINNESOTA: <br /> <br />1. The City hereby enters into a Limited Use Permit with the State of Minnesota, Department of <br />Transportation, to construct, operate and maintain a pedestrian trail within the right-of-way of <br />Interstate 35W of the State of Minnesota. The City of Arden Hills shall construct, operate, and <br />maintain said trail in accordance with the Limited Use Permit granted by the Minnesota <br />Department of Transportation. <br /> <br />2.
