e <br />FIRE PROTECTION SERVICE CONTRACT <br />GITY OF ARDEN HILLS <br />LAKE JOHANNA FIRE DEPARTMENT <br />1.0 Parties. This Contract is entered into by and between the City of Arden Hills, a <br />statutory city under Chapter 412 of Minnesota Statues (herein "City"), and the Lake <br />Johanna Fire Department, lnc., a non-profit corporation organized and existing under <br />the provisions of Chapter 317 of Minnesota Statues (herein "Fire Department"); and <br />shall be effective upon approval by both parties. <br />2.0 Purpose & Recitals. <br />A. City is responsible for providing fire protection and prevention services for the <br />people and institutions situated within its boundaries, which geographic area shall <br />hereinafter be referred to as the "Fire Service Area". <br />B. City has authority to enter into this Contract by virtue of provisions in Chapter 412 of <br />the Minnesota Statues and has determined that the mutual undertakings set forth in <br />this contract are desirable, in the public interest, and necessary to provide for the <br />public health, safety, and general welfare of the Fire Service Area. <br />C. Fire Department has provided fire protection and prevention services for the benefit <br />of the "Fire Service Area' and has the necessary personnel, facilities, equipment <br />and training to provide an adequate and reasonable degree of fire protection and <br />prevention services within the Fire Service Area. <br />D. Fire Department has authority to enter into this Contract by the provisions of its <br />Articles of lncorporation and By-laws and desires to provide City with fire protection <br />within the Fire Service Area. <br />3.0 Term. The term of this Service Contract shall extend from the first day of January, <br />2019, until and through the 31st day of December, 2023, ("Gontract Term"). <br />A. Extended Term. The term of this Service Contract shall be automatically renewed <br />for three additional periods ("Extended Term") of five years each unless either <br />party adopts a Termination Rqsolution at a regular or special meeting of the City or <br />Fire Department and communicates such resolution in writing to the other party at <br />least one year prior to the end of the contract term or any successive extended <br />term. <br />1. The first extended term shall commence on the 1st day of January 2024, <br />and shall expire on the 31st day of December,2028. <br />The second extended term shall commence on the 1st day of January, <br />2029, and shall expire on the 31st day of December, 2033. <br />The third extended term shall commence on the 1st day of January,2034, <br />and all expire on the 31st day of December, 2038. <br />2. <br />3.
