ARDEN HILLS CITY COUNCIL—MARCH 25, 2019 10 may impact some of the City's businesses. He anticipated that the playing field would be leveled once the State took action on this matter. In addition, he believed that by passing this Ordinance a message would be sent to the local and State legislators. Councilmember Holden commented she also supported changing the tobacco sales age to 21. Councilmember Scott thanked the young people who came out to speak tonight. He appreciated the fact that they came out to speak regarding this issue. He noted he met with the City's State Rep and explained there was movement in the legislature to take statewide action. He reported there was support in the House but not the Senate. He indicated this may change. He commented on how he was raising his children in a first-generation smoke-free environment. He discussed the importance of not allowing young adults to be exposed to tobacco products at an early age. He explained he would be proposing an amendment to the Ordinance and suggested the Ordinance not take effect until a later date. He stated if the Ordinance were to take effect on Tuesday, March 26,2019, this would put an undo burden on local business owners. City Clerk Hanson reported vendors would be given until July 1, 2019, to comply with the new Ordinance. Councilmember Scott stated he would be supporting the Ordinance as presented. MOTION: Councilmember McClung moved and Councilmember Holden seconded a motion to adopt Ordinance #2019-003 Amending Chapter 3, License and Regulations, Section 350, Tobacco Products removing the blue font language in Subdivision 11 on Page 6 regarding samples, and authorizing summary publication of the Ordinance. Councilmember Holmes requested an amendment to the Ordinance on Page 8, stating she would like to see adult tobacco shops allowed to sell flavored products. She recommended all of the crossed-out language in Subdivision 2 not be crossed out. She supported this amendment because only individuals over the age of 21 could enter an adult tobacco shop. She explained the intent of this Ordinance was to protect those under the age of 21 and this amendment would still be in alignment this this intent. AMENDMENT: Councilmember Holmes moved to amend the Ordinance Amending Subdivision 2 to allow for the sale of flavored tobacco in adult tobacco shops. The amendment failed for lack of a second. Councilmember Holden commented if the purpose was to stop young people from smoking, she had a different view on flavored tobacco than if the purpose was to assist adult smokers from smoking. Councilmember McClung indicated he supported the Ordinance as drafted which would prohibit the sale of flavored products in Arden Hills. Mayor Grant stated he would support the language as written.
