SANITARY SEWER CONNECTION AND USE AGREEMENT <br />MOUNDS VIEW-ARDEN HU LS -U.S. DEPARTMENT OF THE ARMY <br />T <br />1. This Agreement is dated the day of , 19 ,and is entered ;into by -arid <br />.between the City of Mounds -View, a statutory pi under the la sof the State of Minnesota <br />(herein "Mounds View"); the City of Arden Hills, statutory city under the laws of the State . <br />of -Minnesota—(her-ein—"Arden--Hflis"); and- the U. S:—Department-of tha-_Army- (herein --the — <br />RECITA-U <br />2. The Army owns and operates the Twin Cities Army Ammunition Plant- (herein <br />"TCAAP") located within Arden Hills. The Army wishes to comstruct, operate and, maintain <br />a gravity sanitary sewer system and appurtenances (herein the. "Project") which extends from <br />TCAAP to the intersection of County Road H and U.S. Highway. 10 in Mounds View, where <br />it will discharge into a sanitary intercepter owned by Mounds View. The route of the Project <br />crosses a common border between Mounds View and Arden Hills (herein the "-Project Site"). <br />The Project and Project Site are illustrated on Exhibit A, attached. Sanitary sewage will. flow <br />from TCAAP, through the Project, and discharge into the sanitary interceptor owned and <br />operated by Mounds View. Arden Hills is willing to allow the e�tension of the Mounds.View <br />sanitary sewer. system within the borders of Arden Hills; and Moulds View is willing to. accept <br />the sanitary sewage from the Project pursuant to the terms and conditions of this Agreement. <br />TERMS AND C ND TI N <br />3. In consideration of the mutual undertakings herein expressed, the parties :agree as.. <br />follows: <br />3.1 CONSTRUCTION -OF &0 CT: The Army, at its sole cost,. shall construct.the <br />Project and all appurtenances thereto. If Arden Hills elects- to have additional. <br />flow capacity constructed at the time the Project is constructed, Arden Hills shall <br />be solely responsible for additional costs associated with the construction of the <br />additional capacity. The Mounds View and Arden Hills .Engineers shall. be <br />allowed to review proposed plans and specifications for the Project. The <br />connection to the Mounds View sanitary sewer system shall be made according <br />to plans and specifications that have been approved by the Mounds View Engineer <br />as evidenced by the issuance of a Mounds View sapitary sewer permit. <br />3.2 PERMITS: The Army shall <br />authorizations as necessary in <br />from the State of Minnesota, <br />Control Commission. <br />be responsible for obtaining. all permits and::. <br />order to construct tiie Project including permits <br />Ramsey County, and the Metropolitan Waste . . <br />
