CONSENT ITEM — 6G <br />, AZEN HILLS <br />MEMORANDUM <br />DATE: December 9, 2019 <br />TO: Honorable Mayor and City Councilmembers <br />David Perrault, City Administrator <br />FROM: Todd Blomstrom, Interim Public Works Director/City Engineer <br />SUBJECT: Ordinance 2019-008 Amending Chapter 10, Regulating Nonessential Water <br />Usage Upon a Critical Water Deficiency <br />Budgeted Amount: Actual Amount: Funding Sources: <br />N/A N/A Water Fund <br />Council Should Consider <br />Adoption of Ordinance 2019-008 amending Chapter 10, Utilities, by adding Section 1000.24, <br />regulating nonessential water usage upon a critical water deficiency. <br />Background/Discussion <br />On March 25, 2019, the City Council adopted the Local Water Supply Plan for the City of Arden <br />Hills. As part of completing this plan, the City is required to adopt and enforce a Critical Water <br />Deficiency Ordinance to address water conservation restrictions during critical water shortages <br />as declared by executive order of the governor, pursuant to Minnesota Statutes 103G.291. <br />The City Attorney prepared the recommended Critical Water Deficiency Ordinance (Attachment <br />A) based on model ordinance language developed by the League of Minnesota Cities. The <br />proposed ordinance applies to all water customers who own or control water use on any <br />premises. The ordinance establishes procedures if a critical water deficiency is declared by the <br />governor, the mandatory emergency water conservation measures that are to be implemented, <br />and enforcement procedures for violations. The City Attorney and staff recommend adoption of <br />the ordinance. <br />This item was reviewed during the November 12, 2019 Regular City Council meeting and was <br />tabled to address the proposed amount of the fine associated with violations as described in <br />Subd. 7.C. The proposed fine in the amount of $300 per day has been added to the proposed <br />2020 fee schedule under Section 14. <br />Page 1 of 2 <br />
