Attachment C <br />NORTH HEIGHTS LUTHERAN CHURCH <br />PARKING AREA RENTAL AGREEMENT <br />This Rental Agreement ("Agreement") is entered into by and between North Heights Lutheran Church ("NHLC") and <br />National Recoveries, Inc. ("NR") this 161' day of October 2019. In consideration of the promises and mutual <br />covenants, agreements and representations herein contained, and other good and adequate consideration, the <br />receipt and sufficiency of which is acknowledged, it is hereby agreed as follows: <br />DURATION <br />November 1, 2019 to April 30, 2020 (6 months) <br />PAYMENT <br />NR will pay NHLC $4,500.00 per month on the first of each month during this agreement. If this amount <br />remains unpaid on the 15th of the month this agreement may be terminated at the option of NHLC. <br />NR acknowledges that NHLC is a tax-exempt organization and that but for NR use of the rented space, <br />NHLC would be exempt from the payment of property taxes. Because of NR use of the rented space NR <br />must pay the amount owed for property taxes based on NR use of NHLC property, as required by law, to <br />NHLC on May 11t and October 11t, in addition to rent owed under this agreement. The Property Tax <br />obligation may extend beyond the duration of this agreement based on Ramsey County billing cycle. <br />SPACE <br />NHLC agrees to rent out the west portion (attachment "A") of its Arden Hills Campus parking lot "A" <br />suitable to accommodate 250 cars. That space will be available between the hours of 6:00 AM to 9:00 <br />PM Monday through Friday. During the term of this agreement NHLC and NC reserves the right to adjust <br />the rental space of lot "A" and number of cars it will accommodate. Such adjustment must be made in <br />writing providing 30 days' advance notice effective the first of the month. This adjustment option is <br />limited to one adjustment during the term of this agreement. However, any increase in space is subject <br />to NHLC approval. <br />INSURANCE <br />NC must obtain liability insurance coverage, insuring NHLC against all bodily injury, including death, <br />property damage, personal injury and other loss and naming NHLC as an additional insured in the <br />amount of at least $ 1,000,000/per occurrence and $3,000,000 aggregate. Insurance must be provided <br />by a carrier with an A+ or better rating. NR must provide a copy of its certificate of insurance prior to the <br />start of this agreement. <br />MAINTENANCE <br />NR will clean up litter (if any) weekly on Fridays or as needed. NHLC will cover snow removal under its <br />corporate contract. NHLC cannot guarantee snow removal prior to the times listed above. <br />PRIORITY OF USE <br />NHLC reserves the right to limit the space covered under this agreement for the following: <br />1. Funerals: In the event of a funeral, space at our Roseville campus may be made available. <br />2. Activation of its "Cooperative Agreement Pursuant to Public Health Related Emergencies" with <br />Ramsey County. <br />
