r , <br /> EN HILLS <br /> CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. 2019-048 <br /> RESOLUTION APPROVING THE MODIFICATION TO THE <br /> DEVELOPMENT PROGRAM FOR DEVELOPMENT DISTRICT NO. 1 <br /> AND ESTABLISHING TAX INCREMENT FINANCING DISTRICT NO. <br /> 5: TCAAP WITHIN DEVELOPMENT DISTRICT NO. 1 AND <br /> APPROVING THE TAX INCREMENT FINANCING PLAN THEREFOR <br /> A. WHEREAS, it has been proposed that the City of Arden Hills, Minnesota (the <br /> "City") (1) modify Development District No. 1 (the "Development District"); (2) modify the <br /> Development Program for the Development District; (3) establish Tax Increment Financing <br /> District No. 5: TCAAP therein (the "TIF District"); and (4) approve and adopt the proposed Tax <br /> Increment Financing Plan therefor under the provisions of Minnesota Laws, 2009, Chapter 88, <br /> Article 5, Section 16 (the "Special Law"), and Minnesota Statutes, Sections 469.174 to 469.1794, <br /> as amended (the "Act"); and <br /> B. WHEREAS, under the Special Law the City has the authority to establish a tax <br /> increment financing district within the TCAAP Boundary Survey dated December 12, 2007, by <br /> W. Brown Land Surveying, Inc., consisting of Parcels 163023210001 and 093023320001 (the <br /> 'Project Area"); and <br /> C. WHEREAS, the TIF District is located within the Project Area. <br /> B. WHEREAS, the City Council has investigated the facts and has caused to be <br /> prepared the Modification to the Development Program for the Development District (the <br /> "Development Program Modification"), and has caused to be prepared a proposed tax increment <br /> financing plan for the TIF District therein(the "TIF Plan"); and <br /> C. WHEREAS, the City has performed all actions required by law to be performed <br /> prior to the approval of the modification of the Development District and the establishment of <br /> the TIF District therein, and the adoption of the Modification to the Development Program and <br /> TIF Plan therefor, including, but not limited to, a review of the Planning Commission of the <br /> proposed Development Program Modification, notification of Ramsey County and Independent <br /> School District No. 621 having taxing jurisdiction over the property to be included in the TIF <br /> District, and the holding of a public hearing upon published and mailed notice as required by <br /> law. <br /> 1 <br />
