1 <br /> <br /> <br />CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA RESOLUTION NO. 2020-004 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT <br />AMENDMENT FOR THE SUBJECT PROPERTY 1261 COUNTY ROAD E W <br />WHEREAS, City Staff received a land use application for a conditional use permit amendment <br />request to amend the language of the existing a Special Use Permit (“Special Use Permit Case No. <br />84-5”) at 1261 County Road E W (“Subject Property”); <br />WHEREAS, the Subject Property was approved for Special Use Permit Case No. 84-5 by the City <br />Council that gave the Applicants permission to operate a veterinary clinic; <br />WHEREAS, when the City adopted its current Zoning Code in 1993, the Subject Property no <br />longer needed a Special Use Permit to operate a clinic in the B-2 District because the a clinic is a <br />permitted in the B-2 District under the current Zoning Ordinance in Section 1320.05; <br />WHEREAS, the City Council directed Staff to prepare a Land Use Application Public Policy <br />Notification to notify all property owners within 500 feet of Subject Property when a request for <br />the Planning Commission is to occur related to a land use application that does not require a public <br />hearing; <br />WHEREAS, the City’s obligation has been met where the Arden Hills Planning Commission <br />duly held a hearing on January 8, 2020. All persons present at said meeting were given an <br />opportunity to be heard and present written statements; <br /> <br />WHEREAS the Planning Commission considered the recommendation of the City Staff that this <br />request be approved and, as such voted 5-0 in favor of the request; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY <br />OF ARDEN HILLS: <br />Hereby adopts Resolution 2020-004 approving Planning Case 19-017 for a conditional use permit <br />amendment request at the Subject Property 1261 County Road E W. <br />BE IT FURTHER RESOLVED that City Council approves Planning Case 19-017 for a <br />conditional use permit amendment request at the Subject Property 1261 County Road E W, based
