<br />City of Arden Hills <br />City Council Meeting for March 9, 2020 <br />P:\Planning\Planning Cases\2019\19-002 – Summit Development – CPA, RZ, SP, CUP, FPUD, PP, FP <br />Page 2 of 2 <br />Council adopt a motion to approve the Development Agreement and Final Plat for Summit <br />Development, Planning Case 19-002, subject to the conditions of approval listed below. <br /> <br />1. This Final Plat approval shall be contingent on the Metropolitan Council approval of the <br />Comprehensive Plan amendment re-guiding the subject site to High Density on the land <br />use plan. <br />2. All conditions of Planned Unit Development and Preliminary Plat approval shall remain in <br />full force and effect. <br />3. The Development Agreement shall be fully executed and the required financial <br />guarantees shall be provided prior to the release of the Final Plat. <br />4. The Final Plat shall be recorded prior to issuance of a building permit. <br />5. The Developer shall deed Outlot A to the City at no cost and free of all encumbrances. <br />6. The Developer shall be financially responsible for 100 percent of all storm sewer, sanitary <br />sewer and water main area and connection charges applicable to the property. These <br />charges are identified in the Development Agreement. <br />7. All permanent easements and rights-of-way (ROW) necessary for existing and proposed <br />street and utility improvements shall be granted to the City at no cost or paid for by the <br />Developer. <br />8. All access easements, private easements, and drainage and utility easements shall be <br />finalized prior to recording the Final Plat. <br />9. The Applicant shall provide the City with a title opinion, title insurance binder, or other <br />professional certification on the status of title before the Final Plat will be released. <br /> <br />Budget Impact: <br /> <br />NA <br /> <br />Attachments: <br /> <br />A.
