Page 1 of 2 <br /> <br />AGENDA ITEM – 1B <br /> <br />MEMORANDUM <br /> <br />DATE: April 20, 2020 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Joe Hartmann, Associate Planner <br /> <br />SUBJECT: Accelerated Abatement Discussion <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> <br />Background <br /> <br />The existing City Code process prescribed for abating properties can take anywhere from 20 days <br />to over a month to complete from the time when the violation is first identified to the time when <br />the abatement can be carried out. City Code section 602.05 requires the enforcing officer to serve <br />a written notice of violation to the property owner on record. If the violation is not corrected within <br />the time frame required, staff will follow up with a written notice that a public hearing will be <br />convened for the City Council to determine if an order to abate is necessary. The public notice <br />must be posted 10 days prior to the meeting. At the Council’s discretion staff will serve a written <br />order to abate to the property owner outlining the date, time, and nature of the abatement to occur. <br /> <br />Short summary of the amendments <br /> <br />The proposed amendments are intended to expedite the abatement process for certain violations as <br />permitted by Minnesota State Statute 429.101. If at the end of the time period allowed for <br />correction of a violation the violation still exists, the enforcing official may contract with a private <br />or public means to correct the violation The Statute allows the City to collect unpaid special <br />charges for abating a nuisance for all or any part of the cost of the work plus administrative fees <br />as a special assessment for the following violations: <br /> <br />1. Snow, ice or rubbish removal from sidewalks; <br />2. Elimination of weeds from the streets or private property and elimination of weeds and <br />grass in excess of the height limitations specified in this Code; <br />3. Removal or elimination of public health or safety hazards from private property, excluding <br />any structure included under the provisions of Minn. §§ 463.15 to 463.26; <br />4. Repair of water service lines <br />5. The treatment and removal of insect infested or diseased trees on private property;
