Page 4 of 4 <br />Reimbursable expense other than those listed above (i.e.- deliveries, out of town travel <br />expenses, outsourced reproduction services) will be billed at cost times a factor of 1.15. <br />MISCELLANEOUS <br />1. The following shall be submitted to Paulson & Clark Engineering, Inc.: <br />A. Copy of existing building documentation, if available. <br />B. Architectural backgrounds compatible with AutoCAD 2018. <br />2. Paulson & Clark Engineering, Inc. & associated consultants shall not be <br />responsible for the means, methods, procedures or sequences of <br />construction, safety on the job or have direct control of the contractor during <br />this project. <br />3. Inasmuch as the remodeling &/or rehabilitation of an existing structure <br />requires that certain assumptions be made regarding existing conditions, & <br />because some of these assumptions may not be verifiable without additional <br />expenditures of money or destroying otherwise adequate or serviceable <br />portions of the structure, the Client agrees to bear all costs, losses, & <br />expenses, including the expense of Additional Services by Paulson & Clark <br />Engineering, Inc., arising or allegedly arising from the discovery of concealed <br />or unknown conditions in the existing structure. <br />4. The standard of care for all professional services performed or furnished by <br />Consultant under this Agreement will be the skill & care used by members of <br />Consultant’s profession practicing under similar circumstances at the same <br />time & in the same locality. Consultant makes no warranties, express or <br />implied, under this Agreement or otherwise, in connection with Consultant’s <br />services. <br />5. It is acknowledged by both parties that Paulson & Clark Engineering, Inc. <br />services do not include any services related to asbestos, lead paint, or <br />hazardous or toxic materials. <br />6. All claims, disputes, & controversies arising out of or in relation to the <br />performance, interpretation, application, or enforcement of the Agreement, <br />including but not limited to breach thereof, shall be referred for mediation <br />under the then current construction industry mediation rules of the American <br />Arbitration Association, prior to any recourse to arbitration or litigation. <br />7.
