The proposed variance will not impact <br />any other setback requirements besides the front setback flexibility requested and the property will <br />otherwise conform to all provisions for the R-1 district. <br /> <br />Plan Evaluation <br /> <br />The Applicants are proposing to replace instead of repair the existing structure. According to the <br />Applicants the decking and bridge is failing due to rotting wood after over 50 years in service and <br />some of the current two-by-four support structure is not up to current state building code standards. <br /> <br /> The Applicants are requesting a variance to build a twelve (12) foot wide deck to replace the existing three foot, nine inch wide deck. Under City <br />Code Section 1325.03, Subd. 2, the deck is permitted to encroach six (6) feet into the required front yard setback. <br /> <br />Sketches that have been submitted show that the replacement walkway would be the same size and <br />length as the current walkway, but the replacement deck would exceed the area of the deck <br />currently in place. The Applicant could replace the deck with a new deck of the same size without <br />a variance, but they are asking for a variance to build a larger deck than would be allowed by code. <br /> <br />City Code section 1325.03, Subd. 2 permits decks to encroach six (6) feet into the required front <br />yard setback.
