,It -AREN_ HILLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION NO. 2020-027 RESOLUTION APPROVING A CONDITIONAL USE PERMIT AND AMENDED PLANNED UNIT DEVELEOPMENT FOR THE SUBJECT PROPERTY 1700 HIGHWAY 96 W WHEREAS, City Staff received a land use application for 1700 Highway 96 W("Subject Property")for a Conditional Use Permit and Amended Planned Unit Development request on May 121h, 2020; WHEREAS,the Subject Property is located in the R-1 —Single Family Residential Zoning District and is guided as Public & Institutional use on the Land Use plan; WHEREAS, the Subject Property's use as a house of worship was previously approved under a Planned Unit Development ("Planning Case No. 84-21") but did not include a provision for a preschool use; WHEREAS, a Planned Unit Development Amendment is required when a proposed use is not identified within the existing Planned Unit Development Agreement; WHEREAS, Conditional Use Permits are required when any structural alteration, enlargement or intensification thereof, or change is not specifically permitted by right in a district; WHEREAS, the Applicant has requested a Conditional Use Permit in order to operate a proposed preschool and childcare center with the existing facilities of the church; WHEREAS, Subject Property meets the special district provisions for the R-1 District to operate a general education use; WHEREAS, the City Council directed Staff to prepare a Land Use Application Public Policy Notification to notify all property owners within 1,000 feet of Subject Property when a request for the Planning Commission is to occur related to a land use application that does not require a public hearing; WHEREAS, the City's obligation has been met where the Arden Hills Planning Commission duly held a public hearing on July 8th, 2020.
