CONSENT ITEM—6C <br /> ,-iI�EN HILLS <br /> MEMORANDUM <br /> DATE: August 24, 2020 <br /> TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> FROM: Julie Hanson, City Clerk <br /> SUBJECT: Resolution 2020-031 Relating to Flavored Tobacco Sales Enforcement <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> Council Should Consider <br /> The Council should consider approving Resolution 2020-031 staying the date of enforcement <br /> relating to the sale of flavored tobacco. <br /> Back2round/Discussion <br /> The lawsuit brought by Arden Hills Tobacco against the City is still proceeding, although there <br /> have been challenges due to the pandemic and additional judicial proceedings arising from the <br /> intervention of Brausen Auto into the lawsuit. Consequently, the resolution of the lawsuit is not <br /> expected to occur until sometime in 2021. By previous action, the Council delayed the effective <br /> date of enforcement of the tobacco flavor regulation until December 31, 2020. <br /> In light of these developments, attorneys for the City have recommended the Council pass a <br /> motion to approve Resolution 2020-031 suspending enforcement action until the Ramsey County <br /> District Court enters final judgment in the lawsuit. <br /> Budget Impact <br /> N/A <br /> Attachment <br /> Attachment A: Resolution 2020-031 <br /> 1 <br />
