Area Conditions <br />Location: The property is located on County Road E between Snelling Avenue and <br />Hamline Avenue. <br />Zoning:R-l, Single Family Residential District <br />Requirements: Lot area: 14,000 sf; lot width: 95 ft; lot depth 130 ft; front yard: 40 ft; side <br />yard lOft. minimum/25 ft total. Accessory structure rear and side yard <br />setback lOft. <br />Land Use:Single Family home in a neighborhood of single family homes and Lindy's <br />Steak House. <br />Lot Size:Rectangular/Triangular in shape, 125 feet wide in front 23 feet wide in <br />rear and approximately 200 feet in depth with an area of 14,226 square <br />feet <br />Terrain:Flat, with some trees. <br />Conditions Required for Approval of a Variance <br />Minnesota State Statue in Chapter 462.357, Subdivision 6, (2), defines "undue hardship" <br />as: "... means the property in question cannot be put to a reasonable use if used under <br />conditions allowed by the official controls, the plight of the landowner is due to <br />circumstances unique to the property not created by the landowner, and the variance, if <br />granted, will not alter the essential character of the locality. Economic considerations <br />alone shall not constitute an undue hardship if reasonable use of the property exists under <br />the terms of the <br />ordinance...". <br />A. General Ordinance Requirement. <br />The conditions required for the approval of a variance are found in Section VIII, <br />D, 4, c, of the City Code which states the following: "Adherence to the provisions <br />of this ordinance is required, except for special cases which arise because of the <br />configuration of a particular parcel. The condition shall not have been created by <br />the landowner. A variance or variances of a side of a lot, the shape of the lot or <br />the unusual terrain prohibit reasonable development equivalent to that which <br />would be permitted without variance on a similar size lot located in the same <br />district, but which lot has no unusual configuration. Economic conditions alone <br />shall not be grounds for a variance." <br />B. Other Zoniug Ordinance Requirements. <br />I, The variance shall not impair the health, safety, comfort and general <br />welfare of the public; <br />2. The variance shall not be contrary to the intent and purpose of the <br />Comprehensive Plan, Official Map or any Ordinances of the City; <br />3. Variances shall not allow a use in a district that is not otherwise allowed; <br />and;
