1 <br /> <br /> <br />CITY OF ARDEN HILLS <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA RESOLUTION NO. 2020-045 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT FOR THE <br />SUBJECT PROPERTY AT 4200 ROUND LAKE ROAD <br />WHEREAS, City Staff received a land use application for 4200 Round Lake Road <br />(“Subject Property”) for a Conditional Use Permit request on May 1, 2020; <br />WHEREAS, the Subject Property is located in the GB, Gateway Business District and is <br />guided as Light Industrial & Office on the Land Use Plan; <br />WHEREAS, the Applicant has requested a Conditional Use Permit in order to operate a <br />warehouse use; <br /> WHEREAS, the City’s obligation has been met where the Arden Hills Planning <br />Commission duly held a public hearing on September 9th, 2020. All persons present at said <br />meeting were given an opportunity to be heard and present written statements; <br /> <br /> WHEREAS the Planning Commission considered the recommendation of the City Staff <br />that this request be approved and, as such voted 7-0 in favor of the request; and, <br /> <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY <br />OF ARDEN HILLS: <br />Hereby adopts Resolution 2020-045 approving Planning Case 20-010 for a Conditional Use Permit <br />request at the Subject Property 4200 Round Lake Road to operate a warehouse use based on the <br />findings of fact and the submitted plans in the July 27th, 2020 Report to the City Council, as <br />amended by the following conditions: <br />1. The project shall be completed in accordance with the plans submitted and as amended <br />by the conditions of approval. Any significant changes to the plans, as determined by <br />the City Planner, shall require review and approval by the City Council. <br />2. The Preliminary Plat approval shall expire six months from the date of the City Council <br />approval unless the Final Plat has recorded with Ramsey County or a time extension <br />granted by the City Council. <br />3. The Applicant shall record the Final Plat with Ramsey County and a copy shall be <br />provided to the City within sixty (90) days of the City’s approval. <br />4. The Applicant shall be financially responsible for all applicable water and sanitary <br />charges. Rates applied shall be those in effect at the time of Final Plat approval and <br />shall be memorialized in the Development Agreement.
