District Provisions 1320.13- Flexibility requested <br />According to City Code Section 1320.13, office uses cannot occupy less than 25 percent of a <br />project's total floor area and not more than 50 percent. In addition, warehousing and wholesaling <br />uses shall not exceed 75 percent of the building in which it is located. While the final tenants are <br />unknown at this time, the Applicant is anticipating to attract a wide variety of light industrial <br />tenants with uses including office, manufacturing, research and development, and/or warehousing. <br />The Applicant is requesting flexibility to increase this requirement for warehousing and <br />wholesaling to 85 percent and the remaining 15 percent dedicated to non-warehouse uses such as <br />a combination of uses including-but-not-limited-to office, manufacturing, production, R&D, lab <br />and/or showroom. The Applicant would like to further discuss the Council proposed 80 percent <br />warehouse and 20 percent office split. <br />B. Minimum Caliper Inches – Flexibility Requested <br />Tree mitigation is not required as the current site has no trees deemed significant per City Code. <br />The Zoning Code requires that a minimum number of caliper inches of trees be provided based on <br />the gross square footage of the building on the property. A single story building in excess of thirty <br />(30) feet in height shall be considered a two-story building for the purposes of determining gross <br />square footage. The proposed building would be considered two-stories, and includes 499,552 <br />gross square feet. This requires a minimum of 1,561 caliper inches or 624 two inch caliper trees. <br />The proposed site is limited to where trees can be planted onsite due the wetlands and overhead <br />power lines. The Applicant was previously proposing 310 caliper inches or 110 trees. In response <br />to City Council comments the Applicant has added 100 caliper inches or 31 trees in the areas <br />identified in the image below. The total proposed is 410 caliper inches or 210 trees. Staff has <br />reviewed City Code and has spoken with the City Attorney and given the request for flexibility <br />via the PUD process the Council could request off-site tree planting or fee in lieu for the minimum <br />caliper inches standard. The Applicant would like to further discuss this with the Council at the <br />upcoming meeting.
