'It <br />-fiI�EN�HILLS <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 2020-070 <br />RESOLUTION APPROVING THE VACATION OF DRAINAGE AND UTILITY <br />EASEMENT AT 1740 PARKSHORE DRIVE <br />WHEREAS, Summit Development, submitted an completed application with the City of <br />Arden Hills to vacate the drainage and utility easements in ARDEN HILLS SENIOR LIVING <br />located within the City of Arden Hills, as proposed in Planning Case 19-002; and <br />WHEREAS, the subject drainage and utility easements way were dedicated in the plat of <br />ARDEN HILLS SENIOR LIVING as depicted in Exhibit "A"; and <br />WHEREAS, the Applicant is requesting to vacate the southern five (5) feet of the <br />segment of existing Drainage and Utility Easement on ARDEN HILLS SENIOR LIVING plat. <br />The proposed easement vacation is located along the westerly 200 feet of the north lot line for <br />Lot 1, Block 1 as depicted in Exhibit `B"; and <br />WHEREAS, on the 14th day of December, 2020, a Public Hearing preceded by <br />published, posted, and mailed notice as required by Minn. Stat. §412.851 was conducted before <br />the Arden Hills City Council; and <br />WHEREAS, vacating the existing drainage and utility easement will not impact public <br />health safety and welfare; and <br />WHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council <br />determined that vacating the existing drainage and utility easement is in the public's interest. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden <br />Hills: <br />1. The segment of drainage and utility easement as described above and depicted in Exhibit B <br />is hereby vacated. <br />2. The Applicant is directed to file a certified copy of this Resolution with the County Auditor <br />and County Recorder/Registrar of Titles. This resolution must be recorded just prior to the <br />issuance of a building permit. <br />3. The Applicant must provide the City proof of recording. <br />
