<br />Page 1 of 2 <br />CONSENT ITEM – 7H <br /> <br /> MEMORANDUM <br /> <br />DATE: May 24, 2021 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: David Swearingen, Interim Public Works Director <br /> <br />SUBJECT: AHSL Partners, LLC (Trident Development) - Maintenance Agreements required <br /> by Rice Creek Watershed District <br /> <br /> <br />Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> <br /> <br />Council shall consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />• Agreement Regarding Watershed Maintenance Agreement between AHSL Partners LLC <br />and City of Arden Hills. <br />• Stormwater Maintenance Agreement between the Rice Creek Watershed District and City <br />of Arden Hills. <br /> <br />This action requires a simple majority vote of the Council. <br /> <br />Background <br /> <br />On April 26, 2021 Council adopted a motion to approve the amended Stormwater and Recreational <br />Facilities Operations and Maintenance Agreement for Trident Development, Planning Case 19- <br />002. <br /> <br />As seen in Attachment A, Basin #20 is located on City property but the City is requiring the <br />property owner to maintain. The Rice Creek Watershed District currently does not have a protocol <br />for stormwater facility maintenance obligations by private parties for facilities located on property <br />owned by a public entity. The recommended way to proceed with the stormwater maintenance <br />obligation would is to have two separate documents for each respective facility, where AHSL <br />Partners LLC would complete a maintenance declaration for Basin 10 and the City would complete
