<br /> <br /> <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION NO. 2021-031 <br /> <br />RESOLUTION ALLOWING FLEXIBILITY FOR LOCAL BUSINESSES DURING <br />LOCAL EMERGENCY FOR COVID-19 <br />WHEREAS, on March 17, 2020, the Governor’s Executive Order 20-04 temporarily <br />closed restaurants, bars, and other places of public accommodation; and <br /> <br /> WHEREAS, the Governor is beginning to loosen restrictions on businesses, <br />restaurants, bars and other places of public accommodation; and <br /> <br />WHEREAS, the City wants to make temporary accommodations for businesses that <br />can open in compliance with the Governor’s directives; and <br /> <br />WHEREAS, these temporary accommodations may include allowing flexibility with <br />respect to the City Code or other regulations, and <br /> <br />WHEREAS, the City Council discussed extending this flexibility at a previous <br />meeting; <br /> <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden <br />Hills, Minnesota, that local businesses may request temporary approval from the City <br />Administrator, or their designee, to operate in outdoor spaces adjacent to their normal <br />location that would normally be prohibited by City Code or require a variance if the <br />following conditions are met by the business: <br /> <br />-Compliance with all the Governor’s guidance regarding safe business operations <br />including a social distancing plan. <br />-Safe pedestrian flow must be maintained. <br />-ADA guidelines are observed. <br />-Cannot conflict with any building codes or requirements. <br />-If portions of a parking lot are being used, safe pedestrian and traffic flow must be <br />maintained. Adequate parking spaces must be maintained. A substantial barrier must <br />divide outdoor space being used for customers and traffic flow. <br />-Public Safety response must not be infringed upon. <br />-The proposed outdoor space will not be on City property or right-of-way. <br />-If the business is not the property owner, the business must receive written consent <br />of the property owner to use the proposed space. <br />-Expansion or use of outdoor space is on a case-by-case basis and will be reviewed by <br />City Staff.
