Page 1 of 2 <br /> <br />CONSENT ITEM – 6E <br /> <br />MEMORANDUM <br /> <br />DATE: June 28, 2021 <br /> <br />TO: Honorable Mayor and City Councilmembers <br /> Dave Perrault, City Administrator <br /> <br />FROM: Jane Kansier, AICP, Consulting City Planner <br /> <br />SUBJECT: PC20-010 – Consent and Recognition Agreement with Scannell Properties <br /> <br /> Budgeted Amount: Actual Amount: Funding Source: <br /> N/A N/A N/A <br /> <br /> <br />Council Should Consider <br /> <br />Motions to approve, table, or deny the following: <br /> <br />x The Consent and Recognition Agreement for the Master Planned Unit Development <br />Agreement with Scannell Properties based on the City Council approval of Planning Case <br />20-010 on October 12, 2020. <br /> <br />All items need a simple majority for action unless otherwise noted. <br /> <br />Background <br /> <br />At its February 8, 2021 meeting the City Council approved a Development Agreement for the <br />Master Planned Unit Development, Conditional Use Permit, Site Plan and Preliminary/Final Plat <br />for Scannell Properties. The Master Plan PUD Agreement allowed the subdivision of the subject <br />parcel into two (2) new lots of record and permitted the construction of a 250,000 square foot <br />office and warehouse facility. The approved Master PUD Agreement has been signed and <br />recorded (Attachment B). <br /> <br />The Developer recently requested the City approve and sign a Consent and Recognition <br />Agreement (Attachment C). The agreement essentially states that the City consents to the loan <br />and should the developer default under the loan, the City will recognize the lender as the <br />Developer so the lender can complete the project. <br /> <br />The City Attorney has reviewed the proposed Consent and Recognition Agreement. He notes this <br />type of agreement serves as a preapproval for the lender to take over the project should the
